These Terms of Service apply to all users of the site including but not limited to browsers, vendors, customers, merchants, and/or contributors of content. We reserve the right to refuse service to anyone for any reason at any time.

U.S. and International Shipping
Marigold & Grey currently ships within the United States. For Custom Gift Design Service clients, Marigold & Grey ships internationally on a case-by-case basis depending on the requirements of each individual project.
The Term 'Free Shipping'
Unless otherwise specified, offers of "free shipping" throughout the Marigold & Grey website and across all social media accounts, refers to free shipping within the contiguous United States only. U.S territories, Alaska, Hawaii and shipping destinations other than the United States are not entitled to free shipping. If a destination address is eligible for 'Free Shipping', a 'Free Shipping' option will appear in the cart at checkout. 'Free Shipping' is offered on gift boxes priced over $100. Gift boxes priced under $100 will be presented with paid shipping options at checkout.
To Submit an Address List to Convert a Bulk Shipping Order to an Individual Drop-Shipping Order:
If you placed a bulk order (defined as an individual order placed for more than one gift box at at time shipping to the same location) and wish to submit an address list to have your gift boxes drop-shipped to individual recipient addresses, we are happy to help convert your order from bulk shipping to individual drop shipping! Please email hello@marigoldgrey.com with your order number and we will reply back with a blank address template for you to complete along with an invoice to cover the difference in shipping cost between bulk shipping and individual drop shipping.
Temperature Controlled Shipping:
During warmer months of the year, M&G will ship gift boxes containing chocolate in temperature controlled packaging. A $10 surcharge covering materials will automatically be added to the cart for these specific gift boxes only. For reference, this designation applies to less than 10% of our online offering. Gift boxes that require temperature-controlled shipping will have this designation indicated in their product description. If you are interested in a particular gift box but wish to avoid this seasonal surcharge, please reach out to our team via hello@marigoldgrey.com and we will be happy to recommend a suitable alternative.
Online Account Registration
Marigold & Grey offers online customers the ability to sign up for an online account for faster online checkout and the ability to view order history. Online account registration may be done via marigoldgrey.com/account/login. By signing up for a Marigold & Grey online account, users will automatically be enrolled in Marigold & Grey's 'Gold Level Gifters' Loyalty Program.
Intellectual Property
Marigold & Grey gift designs are the sole property of Marigold & Grey. Gifts may not be resold without written permission from Marigold & Grey. Gift designs may not be altered in any way and still presented as Marigold & Grey via social media, blogging or any other public forum.
Changes to Terms & Conditions
Marigold & Grey Inc. reserves the right to update or modify these Terms & Conditions at any time without prior notice. Any changes will become effective upon posting. Your access or use of the MarigoldGrey.com website following any such change constitutes your agreement to follow and be bound by the Terms & Conditions as changed. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Food Allergy Disclaimer
Food products that Marigold & Grey provides are generally labeled with possible allergen-containing ingredients from the manufacturer. Any non-labeled food always has a risk of possible allergen contamination. All clients and their guests are encouraged to read the labels before consuming. Marigold & Grey will not assume any liability for adverse reactions to food consumed including labeled and non-labeled food products.
Substitutions
We pride ourselves on working with small-batch and local artisan businesses and as a result, certain items can become unavailable on occasion without a lot of advanced notice. In the event an item is unavailable at the time of being ordered, we reserve the right to substitute an item of the same type, of equal or greater value, and as close to your original item as possible. If the item is especially unique and an appropriate substitution doesn’t exist, we’ll omit the item and issue a credit.
Warm Weather Shipping
Please note that ordering items subject to melting is at your own risk. Quality upon delivery of these items cannot be guaranteed by Marigold & Grey. Marigold & Grey will not issue refunds as a result of melting regardless of the time of year.
Product Packaging
On occasion, manufacturers may update their product packaging and ingredient lists. As a result, actual product packaging may differ from what is displayed on MarigoldGrey.com. It is the responsibility of the client and guests of the client to always read labels, warnings, and directions before using or consuming a product. For most current and/or additional information about a product, please contact the manufacturer.
Product Images
Marigold & Grey has made every effort to display as accurately as possible the images of its products that appear at the Site. We cannot guarantee that your computer monitor’s display of any product will be completely accurate.

Hotel Delivery
While we do our best to communicate directly with the hotel on your behalf, we are not responsible for welcome gifts after they have been delivered and signed for by hotel personnel. It is the responsibility of the personnel of the hotel to notify the guest that there is a gift at the front desk and/or present the hotel guest with the gift. We do not offer refunds for packages not provided to hotel guests once the responsibility has been assumed by hotel personnel. We are not responsible for unclaimed packages. It is your responsibility to know and abide by the hotel’s policies regarding welcome gifts and any associated fees that may apply. Marigold & Grey is not responsible for delivery welcome gifts to guest rooms.
Unclaimed Shipments
Marigold & Grey is not responsible for packages unclaimed by recipients and therefore will not issue refunds or store credits for any unclaimed packages.
Damages
We must receive notification of damaged products within 24 hours of delivery. For products damaged during shipping, please keep all original packing material for courier inspection in order to file a claim with our shipper. We require an image of the damage to be emailed to us at hello@marigoldgrey.com for our review.
Marketing
Marigold & Grey Inc. reserves the right to include a business card and/or insert card inside each welcome gift. We also reserve the right to publish finished products on social media, industry blogs as well as the Marigold & Grey Blog.
Customizable Items
All customizable items (i.e. personalized gift tag or sticker templates, uploaded documents, custom printing) included as part of an order will be printed exactly as they are submitted by the customer. It is the customer’s sole responsibility to ensure that all submissions are correct. Marigold & Grey Inc. is not responsible for any misspellings, typographical errors, omissions, or any other inaccuracies contained in any submissions provided by the customer.
Changes to Pricing & Services
Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

Loyalty Program Registration
Registration for the Loyalty Program may be achieved by signing up for a Marigold & Grey online account via marigoldgrey.com/account/login. Any website user who signs up for a Marigold & Grey online account will automatically be enrolled in the Loyalty Program.
Loyalty Program Program Period
This Program will continue until terminated, suspended, modified, or converted to another rewards program by Marigold & Grey (the”Program Period”).

To become a Member of the Program, you simply need to have registered for a Marigold & Grey account.
Loyalty Program: Earning Gifting Gold
Once you have become a Member, you can begin racking up Marigold & Grey Gifting Gold (“Gold Coins”) the following ways:
- Shop — every time you purchase a product from our online shop (the“Shop”), you earn 1 Gold Coin for every whole $1 spent per order (excluding tax, shipping charges and fees). Applies to purchases made post-registration only.
- Refer friends — earn 500 Gold Coins for every friend who makes an online purchase using a unique link provided to you via your Program Membership.

Upon notice, Marigold & Grey reserves the right to suspend, terminate, revalue or modify, without liability to Members, all or part of the Gifting Golds’ value structure and offers and any merchandise or service. Marigold & Grey reserves the right to adjudicate all Gold Coin discrepancies in its sole discretion, and the Members agree to abide by any such adjudication. Loyalty Program Gifting Gold Redemption
The Gold Coins are redeemable towards online purchases. You can redeem your Gold Coins during the checkout process. Points are available for redemption for the purchase of products only while supplies last. Product quantities may be limited. Gifting Gold is redeemable for online orders only and does not apply to Custom Gift Design projects.
Loyalty Program Redemption Values
500 COINS = $10 off next online purchase
1000 COINS = $25 off next online purchase
2000 COINS = $100 off next online purchase
Gifting Gold is redeemable on orders not already using a discount code. Discount codes may not be combined in the same order.
Loyalty Program Refunds & Returns
Any items received as a result of Gold Coin redemption may only be exchanged for a refund of the applicable Gold Coins redeemed for such item (not cash or credit). Purchases made with Gold Coins will ship in the normal course of business. Gold Coins earned via credit card transaction purchases on the Site will be rescinded in the event that such purchase is returned for a refund.
Loyalty Program Points Minimums And Maximum
You cannot redeem Gifting Gold for more than the total amount of your purchase. Points are not redeemable for cash.
Loyalty Program Gold Coin Points Expiration
As of this point in time, points do not expire. The portal on our website on the bottom righthand side of the page will provide your current Gold Coin balance.
Loyalty Program Reward Conditions
Gifting Gold may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to Member. Members are solely responsible for reporting such items on their tax returns and paying any associated tax liability. Members may not assign or transfer any Gifting Gold. Marigold & Grey makes no warranty in any respect as to any Rewards or service available within the Program.
Loyalty Program Termination
Marigold & Grey may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Reward at any time, including the availability of any Reward. Marigold & Grey may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Loyalty Program Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Loyalty Program Terms and Conditions. Marigold & Grey reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Program if Marigold & Grey deems or suspects that such Member has engaged in or has attempted to engage in any of the following:(a) acting in violation of these Loyalty Program Terms and Conditions; or(b) damaging, tampering with or corrupting the operation of the Program or Site; or(c) acting with intent to annoy, harass or abuse any other person; or(d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or(e) activity deemed in the sole discretion of Marigold & Grey to be generally inconsistent with the intended operation of the Program. Any decision Marigold & Grey makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects. Marigold & Grey shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Loyalty Program Terms and Conditions or intent of these Loyalty Program Terms and Conditions.
Loyalty Program Release
Except for willful misconduct or gross negligence on the part of Marigold & Grey, by participating in the Program, Members release Marigold & Grey, its parent company, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents(collectively,“Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program or the use of any Rewards.
Loyalty Program Indemnification
Members agree to indemnify, defend and hold Marigold & Grey and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Loyalty Program Terms and Conditions or any violation by Member of applicable law.
Loyalty Program Governing Law
The laws of the State of Maryland shall govern these Loyalty Program Terms and Conditions. Member hereby expressly consents to exclusive jurisdiction and venue in the courts located in Maryland for all matters arising in connection with these Loyalty Program Terms and Conditions or Member’s participation in the Program.
Mobile Terms of Service
The Marigold & Grey mobile message service (the "Service") is operated by Marigold & Grey (“Marigold & Grey”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Marigold & Grey’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Marigold & Grey through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Marigold & Grey. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18338062490 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Marigold & Grey mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
